Terms & Conditions
These terms and conditions form part of Bright Yoga Space enrolment agreement with you and apply to the class, appointment or program you have specified and for which you wish to enrol, to the exclusion of all other terms and conditions issued or stipulated by anyone other than Bright Yoga Space. In these terms and conditions, all references to ‘I’, ‘we’ and ‘us’ mean Bright Yoga Space.
Liability Waiver
If you are participating in Bright Yoga Space classes, appointments, courses or events, during which you will receive information about yoga, meditation and health, you recognise that yoga requires physical exertion that may be strenuous and may cause physical injury and you am fully aware of the risks involved. You agree to check with your doctor or therapist if you have any difficulties or concerns about taking part in the class. You agree to advise the teacher of any medical conditions you may have and if those conditions change at any time.
You agree to assume full responsibility for any risks, injuries or damages, known and unknown, which you might incur as a result of participating in the program. You voluntarily and expressly waive any claim you may have against Bright Yoga Space for injury or damages that you may sustain as a result of participating in the program.
Nepal Retreat 2024
REQUIREMENTS OF HEALTH AND EXPERIENCE…
This outdoor experience is suitable for the passionate walker who will be comfortable walking around 3-5 hours a day with a light backpack <8kg. The Trek is less physically demanding compared to the Everest Region Trek. Preparation would include regular daily walks leading up to this trip. You do need to be in good physical and mental health to complete the trip. If you have any pre-existing medical conditions such as heart, lung and blood diseases please inform me before confirming your participation. We are highly conscious of your health and safety. We also recommend that you have a medical check-up with your GP as well.
The yoga and meditation will be accessible yoga to all body types and abilities. All practices are invitational. There is no prior experience necessary to participate in your yoga practices, however you will be encouraged to do so as to enrich the overall connection, depth and experience of yourself and the group.

TERMS & CONDITIONS OF BOOKING
Payment options:
Payment plans are available at the check out. Part payment does not secure your spot. 100% of the payment is required upfront 3 months prior to the retreat to secure your place.
Cancellations:
Cancellation 6 months prior – Full refund minus 5% admin fee
Cancellation between 6 and 3 months prior - 50% refund
Cancellation less than 3 months – no refund (unless place is transferred which must be arranged by yourself)
If you decide after arriving at the retreat that it is ‘not for you’, you will not receive a refund
If we, the organisers cancel due to lack of sufficient numbers, by a certain date determined by us, you will receive a full refund
If there is a natural disaster in the area that prevents us from undertaking the retreat the organisers will make a decision as to the status of the bookings, in the best interest of all parties concerned. You will most likely receive a full refund
General Membership Expectations
Bright Yoga Space may terminate your membership without notice for any behaviour determined by us to be inappropriate, offensive or illegal which occurs on our platform or during our events or is directed at our teachers or other members. We value kindness, respect and integrity and expect that of our community.
Payment
All purchases are final. We will not provide a refund for missed/unattended classes. If you know you will be unable to attend a class, please cancel your booking with the minimum 24 hour notice so that another student can take your place.
Memberships are not refundable or transferable. Members found sharing their memberships, class passes or access codes to our Members Sanctuary will have their membership suspended or terminated by Bright Yoga Space. A refund will not be issued.
Any return/refund request can be made via email to hello@brightyogaspace.com and will be reviewed on a case by case basis.
Suspension or termination request based on medical issues will require written notice from you supported by a medical doctor expressing that you are unable to attend due to injury/illness which exceeds 4 weeks recovery.
Membership Subscriptions
Membership subscriptions are not transferable and may not be shared unless prior approval is provided.
Membership subscriptions will auto-renew every month or year. It is your responsibility to manage your subscription and method of payment in our Wellness Living booking system. Membership subscriptions are for a minimum of one month (unless you have signed a contract specifying a different time period). If you wish to cancel your membership you are responsible for updating this before the next payment is due. Pro-rata refunds will not be approved.
Memberships may be placed “On Hold” for up to 4-6 weeks per calendar year (depending on the membership type: 6-month memberships = 4 weeks, 12-month memberships = 6 weeks) for holidays or injury/illness. Please contact hello@brightyogaspace.com with written request including dates and any supporting documentation. The date for the next membership payment will be adjusted to take the hold period into consideration.
Attending in-person Classes and Appointments
If you are not able to attend after you have registered, please cancel or reschedule your booking more than 24 hours before class starts by following the links in your confirmation email or signing into your schedule in Wellness Living. Any classes cancelled more than 24 hours before class remain as class credit. A no-show (or late cancel) will not receive a refund. Exceptional circumstances will be taken into consideration. Please contact us if you have any queries.
If you are a no show for a class or an appointment this means that someone on the waitlist may miss out. Members will receive 1 ‘strike’ for a no show for class. If a member receives 3 strikes on their account, they will need to pay the casual class rate for any further ‘No Shows'.
Please arrive 5-15 minutes before class/appointment time (15 minutes for first class/appointment). No late comers will be accepted into class and the front door is locked at the class start time. Because the class/appointment spot was reserved no refunds, credits or exchanges apply for a late arrival.
All workshop sales are final – no refunds or exchanges.
Bright Yoga Space will take all measures to provide the services at the times specified on our live class and event schedule. We will not be liable for any loss or damage suffered by you or any third party for any late or cancelled classes or sessions, including classes and sessions cancelled due to public holidays or otherwise.
Intellectual Property
All material relating to the Program for which you are enrolling whether presented during, before or after the Program, is subject to copyright and other intellectual property rights. The copyright in all such materials remains the property of their owners and may not be recorded, used or reproduced, without the written permission of the copyright owner. You agree not to do anything, at any time that would infringe the intellectual property rights in such materials.
Privacy
1. We respect your privacy
1.1. We respect your right to privacy and are committed to safeguarding the privacy of our customers and website visitors. We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). This policy sets out how we collect and treat your personal information.
1.2. "Personal information" is information we hold which is identifiable as being about you.
2. Collection of personal information
2.1. We will, from time to time, receive and store personal information you enter onto our website, provided to us directly or given to us in other forms.
2.2. You may provide basic information such as your name, phone number, address and email address to enable us to send information, provide updates and process your product or service order. We may collect additional information at other times, including but not limited to, when you provide feedback, when you provide information about your personal or business affairs, change your content or email preference, respond to surveys and/or promotions, provide financial or credit card information, or communicate with our customer support.
2.3. Additionally, we may also collect any other information you provide while interacting with us.
3. How we collect your personal information
3.1. We will collect personal information from you in a variety of ways, including when you interact with us electronically or in person, when you access our website and when we provide our services to you. We may receive personal information from third parties. If we do, we will protect it as set out in this Privacy Policy.
4. Use of your personal information
4.1. We may use personal information collected from you to provide you with information, updates and our services. We may also make you aware of new and additional products, services and opportunities available to you. We may use your personal information to improve our products and services and better understand your needs.
4.2. We may contact you by a variety of measures including, but not limited to telephone, email, sms or mail.
5. Disclosure of your personal information
5.1. We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this Policy. Personal information is only supplied to a third party when it is required for the delivery of our services.
5.2. We may from time to time need to disclose personal information to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request.
5.3. We may also use your personal information to protect the copyright, trademarks, legal rights, property or safety of Bright Yoga Space, its customers or third parties.
5.4. Information that we collect may from time to time be stored, processed in or transferred between parties located in countries outside of Australia.
6. Security of your personal information
6.1. We are committed to ensuring that the information you provide to us is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.
6.2. The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us, or receive from us. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with these Terms & Conditions.
7. Access to your personal information
7.1. You may request details of personal information that we hold about you in accordance with the provisions of the Privacy Act 1988 (Cth). A small administrative fee may be payable for the provision of information. If you would like a copy of the information, which we hold about you or believe that any information we hold on you is inaccurate, out of date, incomplete, irrelevant or misleading, please email us at hello@brightyogaspace.com.
7.2. We reserve the right to refuse to provide you with information that we hold about Approved by you, in certain circumstances set out in the Privacy Act.
8. Complaints about privacy
8.1. If you have any complaints about our privacy practices, please feel free to send in details of your complaints to PO Box 527, Bright, VIC, 3741, Australia. We take complaints very seriously and will respond shortly after receiving written notice of your complaint.
9. Changes to Privacy Policy
9.1. Please be aware that we may change these privacy guidelines in the future. We may modify this at any time, in our sole discretion and all modifications will be effective immediately upon our posting of the modifications on our website or notice board. 10.1. When you visit our website When you come to our website (https://www.brightyogaspace.com) we may collect certain information such as browser type, operating system, website visited immediately before coming to our site, etc.
10.2. We may from time to time use cookies on our website. Cookies are very small files which a website uses to identify you when you come back to the site and to store details about your use of the site. Cookies are not malicious programs that access or damage your computer. Most web browsers automatically accept cookies but you can choose to reject cookies by changing your browser settings. However, this may prevent you from taking full advantage of our website. Our website may from time to time use cookies to analyses website traffic and help us provide a better website visitor experience. In addition, cookies may be used to serve relevant ads to website visitors through third party services such as Google Adwords. These ads may appear on this website or other websites you visit.
General
Bright Yoga Space is not liable in any way when prevented from acting by events beyond its reasonable control including and without limitation to industrial disputes, strikes, lockouts, accidents, breakdowns, acts of Nature, acts or threats of terrorism or war. Should an event of force majeure occur, Bright Yoga Space may suspend or terminate the Agreement by written notice to you.
The laws of the state of Victoria govern this agreement. Should any part of this agreement be determined by court to be invalid or unforeseeable, the remainder of the agreement will be unaffected. This agreement may not be varied except with the written approval of Bright Yoga Space. All terms, conditions and warranties implied by statute that are excludable are excluded from this agreement. Such terms, conditions and warranties implied by statute that are not excludable are not excluded from this agreement but our liability for breach of such conditions and warranties implied by statute that are not excludable is limited to the total amount paid by you to Bright Yoga Space under this agreement.
